Since May 2018, cars over 40 years old no longer require an annual MOT. This rolling exemption means that once your vehicle reaches its 40th birthday, you can apply for Historic Tax Exemption and no longer need a valid MOT certificate to obtain a (free) road fund licence.
However, as with all legislation, the details matter. Vehicles that have been significantly modified from their original specification are not exempt. If the engine, gearbox, chassis, or subframe has been changed, your car will still require an MOT. The DVLA cannot automatically track these modifications. It is the owner’s responsibility to declare them and keep the MOT up to date.
For example, fitting a five-speed gearbox to an E-Type removes its exemption. The same applies to kit cars such as Caterham 7s, even if they carry the identity of a 40+ year-old donor vehicle.
Why your exempt classic would benefit from an MOT
Exempt, but not beyond scrutiny
For the vast majority of standard classics, MOT exemption may feel like a relief. But why voluntarily put your car through the test? The answer lies in the detail.
Even without the legal requirement, owners still have a duty to keep their vehicles roadworthy. In the event of an accident, how would you prove to insurers — or the police — that your classic was in safe condition?
So far, there have been no test cases. Yet almost every insurance policy contains a clause requiring regular checks to confirm roadworthiness. What those checks should be, and how you might evidence them in court, is rarely defined.
An annual MOT offers the simplest, clearest way to demonstrate compliance — protecting both you and your classic.
